- In Florida, when you use a notary (that's me, as a mobile notary), I verify your identity, confirm you're willing and aware, and witness your signature on a document. - In Florida, a notary must personally see the signer and rely on either "personal knowledge" or "satisfactory evidence" of the signer's identity. Acceptable IDs include a Florida driver's license or ID card, a U.S. passport, or other IDs listed in the statute (issued within the past 5 years and containing an identification number). Online Sunshine. A photo of your ID on your phone is not acceptable. If you don't have one of the listed IDs, there's a "two credible witnesses" alternative, and I'll walk you through that. - No, in Florida, a notary cannot provide legal advice. Rey Ethan Mobile Notary can verify you're aware of what you're signing, identify the correct notarial act (e.g., acknowledgment vs jurat) when the document states it, and complete the notarization. - In Florida, a notary must refuse if: the signer is not present at the time of notarization; the ID is not valid or adequate; the signer appears incompetent or under duress; or the document is blank/unsigned where required. I'm impartial, but I'm also required to protect you and the record. Reference: Florida statute §§ 117.05 & 117.107 (prohibited acts). - Sometimes, yes, but it depends on the document and whether Florida law or the document allows the notary to serve as a witness. If the document requires two independent, non-interested witnesses and a notary, I'll clarify this in advance. - Federal HIPAA law doesn't require notarization or witnessing. However, many hospitals or care facilities in Florida still prefer notarization for added identity assurance. - Yes, I can notarize POAs, wills, trusts, durable power of attorney, etc., as long as the signer is present and consenting. - Florida permits Remote Online Notarization under statute (Part II of Chapter 117) whereby a Florida-commissioned online notary can perform notarizations via live audio-video. If your document recipient accepts RON and you and I meet the tech/credential-verification requirements, it can speed things up. Reference: Florida statute mentions electronic notarization. - Impartiality is key for a notary. In Florida, a notary must avoid conflicts of interest. If a notary is benefiting from the transaction, or a notary is a party or named in the document, then a notary must decline. - Bring: a valid government-issued photo ID recognized in Florida; the document fully completed (except for signature); any required witnesses; your payment (if applicable).
